Europe’s AI Act Hits Its First Enforcement Phase: But at What Cost?

The European Union has crossed a milestone in its Artificial Intelligence Act: as of August 2, 2025, rules governing general-purpose AI models and the EU’s new AI Office came into effect. For policymakers, this is the payoff from years of debate: Europe now has the most comprehensive, binding AI regulatory regime in the world. The focus is clear: consumer protection and product safety come first.

That lens has been the EU’s hallmark in digital regulation. From GDPR to the Digital Services Act, Brussels has repeatedly moved ahead of the rest of the world in creating enforceable safeguards. The AI Act continues that tradition, demanding transparency, detailed documentation of training data, and clear risk management from providers of general-purpose models. It also mandates governance infrastructure across member states, including national AI authorities and the European Artificial Intelligence Board.

The run-up to August saw a final push to prepare the market. On July 10, 2025, the Commission published a Voluntary Code of Practice aimed at smoothing the transition for general-purpose AI providers. The code centers on transparency, copyright protection, and safety protocols, encouraging alignment with the AI Act even before obligations become legally binding. This was quickly followed on July 18 by guidelines for models with systemic risk, requiring risk assessments, adversarial testing, cybersecurity safeguards, and incident reporting. Non-compliance could mean fines of up to €35 million or 7 percent of global turnover.

The immediate benefits are obvious to anyone concerned about opaque AI systems making consequential decisions: less “black box” mystery, more documentation, and a stronger paper trail for accountability. In sectors like healthcare, banking, and public services, these requirements could prevent catastrophic errors and protect vulnerable populations. Europe is once again proving that it can write the rulebook for emerging technologies with public interest at its core.

But this commitment to safety comes with a steep competitive price. Experts have long warned that the race to artificial general intelligence will be a winner-take-all contest. The player who reaches AGI first will shape the rules, set the standards, and reap outsized economic gains. By layering compliance costs and slowing deployment cycles, the EU may have ensured that player will not be European. Some would argue that was already the case: Silicon Valley commands unmatched private capital and AI talent density, while China’s vertically integrated research and industrial policy gives it a speed advantage Europe cannot replicate.

Industry voices, from Airbus to Mercedes-Benz, have cautioned that the AI Act’s demands could erode Europe’s competitiveness in advanced AI. Brussels has not blinked. As of August 2, the European AI Office and AI Board are operational, and member states have designated national authorities to enforce compliance. For the Commission, the priority is avoiding the harm of unregulated AI, not chasing the speculative prize of AGI dominance.

The coming years will test this philosophy. The next enforcement wave arrives in August 2026 for most high-risk AI systems, followed by a full rollout in 2027. By then, it may be clear whether Europe’s approach has set a global benchmark that others follow or a cautionary tale about prioritizing safety over speed.

For now, Europe has chosen to play a different game entirely. It will not win the AGI race. But it might win something else: the trust of its citizens, and perhaps a model for AI governance that survives long after the first to AGI burns out.
